Quick analysis: FDCPA litigation filings dipped a little from the first half of June, but otherwise continue to almost match 2011’s record numbers, while not quite showing any momentum at this point to surpass them. Meanwhile, FCRA and TCPA continue to show strong growth over 2011 numbers, each on track to blaze impressive new records for 2012.

Quick analysis: FDCPA litigation rebounded from last period but continues an overall decline from 2011’s record numbers, slipping to 6.4% below last years total. However, it is significant to note that last year in the same period there was a single lawsuit with 100 plaintiffs alleging both FDCPA and TCPA claims. That one suit accounts for most of the additional decline from last period, when the YTD numbers were 4.6% below the previous YTD.
TCPA and FCRA are both continuing to show strong growth over last year, even with the above-mentioned 100-plaintiff case skewing last year’s TCPA totals. Both statutes are clearly on track to significantly surpass last year’s totals.

Quick analysis: The second half of February 2012 picked up again from a slow first half for FDCPA (up 7.9%), FCRA (up 25.2%) and TILA (up 37%) litigation. TCPA stayed the course with 44 lawsuits, matching last period’s activity.
Year to date, FCRA and TCPA continue to show strong growth over 2011, while FDCPA is on pace with last year’s number and TILA is considerably lower. Expect FDCPA and TILA to pick up as the year goes on.

Quick analysis: The first half of February 2012 slowed down a bit for FDCPA and TILA litigation after a very active 2nd half of January. Both categories are also down in YTD tracking, FDCPA by about 3.6% and TILA by a strong 43.8% (but don’t expect it to stay that way).
In contrast, numbers stayed strong for FCRA and TCPA litigation, barely moving from last period. Neither show any signs of slowing anytime in the near term. Both statutes are also showing strong YTD growth – FCRA by 66.5% and TCPA by 21.1%

Grand Rapids, MI (February 24, 2012) – Since releasing 2011 litigation statistics, the WebRecon data team has had an opportunity to go back through the year’s complaints more thoroughly. In this process, we have been able to identify some omissions which inadvertently depressed the overall litigation counts for 2011.
Accordingly, we have revised our 2011 consumer litigation counts. Among the noteworthy changes you will see is that FDCPA complaints surpassed 12,000, and both TCPA and TILA litigation were significantly higher than previously reported. FCRA moved upward as well, but the change was less dramatic. Also, the total number of unique consumer litigants has surpassed 13,000.
