Acceptable use policy

PLEASE READ THIS POLICY CAREFULLY BEFORE USING THE SITE OR SERVICES.

https://www.webrecon.com is a website operated WebRecon LLC (“we”, “our”, “us”), a limited liability company registered in Michigan.

This Acceptable Use Policy (the “Acceptable Use Policy”) informs you about the terms that govern your access to and use of our website, https://www.webrecon.com (the “Site”), as well as any software and related services you may use (the “Services”).

Please read this Acceptable Use Policy carefully before you start to access or use our Site and/or Services.

BY USING AND/OR ACCESSING OUR SITE AND SERVICES, YOU CONFIRM THAT YOU ACCEPT AND AGREE TO THIS ACCEPTABLE USE POLICY AND THAT YOU WILL COMPLY WITH IT. IF YOU ARE USING OUR SERVICES ON BEHALF OF A COMPANY, ORGANIZATION, OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU ARE AUTHORIZED TO ACCEPT THIS ACCEPTABLE USE POLICY ON ITS BEHALF. THIS ACCEPTABLE USE POLICY SHALL BE LEGALLY BINDING ON YOU.

If you do not agree to this Acceptable Use Policy, you must not use our Site or Services and should leave the Site immediately and/or immediately stop using the Services.

This Acceptable Use Policy is in addition to any terms or commercial agreements between you and us and shall not replace or supersede any other such terms. Any capitalized terms not defined in this Acceptable Use Policy shall have the meaning given to them in the other terms between Presto and you.

You may only use our Site and Services for lawful purposes. You may not use, or encourage, promote, facilitate, or instruct others to use, our Site or Services for any of the following:

  • Violating any applicable laws, regulations, or third-party rights (including intellectual property, privacy, or publicity rights)
  • Engaging in fraud, money laundering, or other deceptive or illegal practices.
  • Harming or attempting to harm minors in any way.

b. Abuse, Interference, or Disruption

  • Attempting to gain unauthorized access to any part of our systems, networks, or data.
  • Interfering with the normal operation of our Site or Services, servers, or networks.
  • Introducing viruses, malware, or other harmful code.
  • Launching or facilitating denial-of-service (DoS), distributed denial-of-service (DDoS), or similar attacks.

c. Misuse of User Accounts or Credentials

  • Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.

d. Violation of Privacy or Data Protection Laws

  • Violating applicable data protection or privacy laws.

e. Content Restrictions

You may not send, upload, transmit, or distribute content or material that:

  • Promotes violence, discrimination, or hate speech.
  • Infringes on the intellectual property or proprietary rights of others.

  • You know contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

e. Content Restrictions

You may not send, upload, transmit, or distribute content or material that:

f. Other

You may not send, upload, transmit, or distribute content or material that:

  • To transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam).
  • Not to reproduce, duplicate, copy or re-sell any part of our Site or Services in contravention of the provisions of our Policies or any Customer Agreement.
  • To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards, as set out below.

You may not send, upload, transmit, or distribute content or material that:

  • Not to access without authority, interfere with, damage or disrupt:
    • any part of the Site or Services;
    • any equipment or network on which our Site or Services are stored;
    • any software used in the provision of our Site or Services; or
    • any equipment or network or software owned or used by any third party.
  • To comply with any of our directions relating to the protection of any personal data.
Interactive Services
We may, from time to time, provide interactive services on the Site or in tandem with our Services (the “Interactive Services”), including, without limitation, push notifications and internal, in-product notifications or messaging capabilities.

Where we do provide any Interactive Services, we will provide you with clear information regarding the kind of Interactive Services offered. Where any such Interactive Services are provided, they may be moderated, unmoderated, or subject to limited moderation at our discretion. We do not undertake to monitor all activity on or through the Interactive Services, and we disclaim any responsibility arising from use of them. Your use such Interactive Services is at your own risk.

The use of any of our Interactive Services by a minor must be with the consent and under the supervision of their parent or guardian, who remain responsible for their use. We advise parents to speak with their children about online safety, as moderation (where provided) is not foolproof.
Responsibility for End Users and Third Parties
If you are a Customer, you are responsible for ensuring that your clients, members, and other End Users comply with this Acceptable Use Policy, and you may be held responsible for any violation of this Acceptable Use Policy by any of your End Users.If you are an End User, you are responsible for your own compliance with this Acceptable Use Policy and for all activity occurring under your account or credentials, including by anyone you allow or enable (intentionally or negligently) to access the Site or Services on your behalf.
Monitoring and Enforcement
We reserve the right (but do not assume the obligation) to monitor use of our Site and Services and investigate any violation of this Acceptable Use Policy or misuse of the Site or Services. We may:
  • Remove or disable access to content that violates this Acceptable Use Policy, the Terms, or the Customer Agreement.
  • Suspend or terminate accounts or access to our Site or Services.
  • Report violations to law enforcement or regulators, where appropriate.
Reporting Violations
If you become aware of any violation of this Acceptable Use Policy, please report it to us at admin@webrecon.net. We may request additional information from you to investigate the issue.
Suspension and Termination
We will determine, in our discretion, whether you have breached this Acceptable Use Policy. When a breach of this Acceptable Use Policy has occurred, we may take such action as we deem appropriate, including but not limited to:
  • Immediate, temporary or permanent withdrawal of your right to visit or use our Site or Services.
  • Issuing you a warning.
  • Enacting legal proceedings (in equity and common law) against you.
  • Referral to statutory bodies.
  • Disclosure of relevant information to law enforcement authorities as we reasonably feel is necessary.
If we take any reasonable action of the type stated above, then you agree that we will not be liable to you in any way whatsoever in response to breaches of this Acceptable Use Policy. The responses described in this Acceptable Use Policy are not limited, and we may take any other action we reasonably deem appropriate.
Changes to this Acceptable Use Policy
We may revise this Acceptable Use Policy at any time by posting a revised version on our Site. Continued use of our Services and Site after the effective date of any changes constitutes your acceptance of the revised Acceptable Use Policy. You are asked to and expected to check this Acceptable Use Policy page from time to time to take notice of any changes we make.
