Quick analysis: Sooo…. do you remember in January when we told you that the 4925 CFPB complaints filed that month blew past the previous record of 4648 CFPB complaints filed in March 2017? Well, it has happened again with 5225 complaints filed in March 2018, eclipsing January’s record of 4925.

Beyond that, we saw an interesting inversion from recent litigation trends with FDCPA (+7.1%) and TCPA (+15.2%) up, and FCRA (-11.9%) down from the previous month. In spite of that, year-to-date trends on all three statutes are holding steady with FDCPA (-5.4%) and TCPA (20.8%) down, and FCRA (+1%) up, if only nominally.

In other news, putative class actions were mixed last month with 20.7% of FDCPA, 22.5% of TCPA and 4.6% of FCRA lawsuits filed that way.

About 34% of all plaintiffs who filed suit last month had filed at least once before.

And finally, New York attorney Craig B. Sanders retained the crown as the most active consumer attorney this month by representing 95(!) consumers in January and 195 so far year-to-date.

Quick analysis: Is FCRA the New TCPA?

Prelude…vcra big picture.

In a month where the numbers of every other type of complaint was a bit depressed, FCRA has continued its remarkable growth streak, with a strong 422 plaintiffs represented in February invoking the statute.

FCRA used to be the ugly stepchild to TCPA, the statute that almost always had the the slightly better numbers and momentum. That trend appears to have subsided. Notice how the red lines (TCPA) used to be more prominent in the grid below, and how it is now the blue lines (FCRA) creating the most waves.

CFPB complaints, while down from January’s extraordinary number of 4962, is still several hundred complaints above the last 12-months average of 4162 with 4439 complaints for the month of February.

Putative class actions were higher than average last month with 23% of FDCPA, 22.3% of TCPA and 36.3% of FCRA lawsuits filed that way.

About 33% of all plaintiffs who filed suit last month had filed at least once before.

And finally, Ohio attorney Thomas J. Connick broke out of obscurity and took the crown as the most active consumer attorney this month by representing 129 consumers in a mega-FCRA case . Not uncoincidentally, he also has the most consumers represented year-to-date, also 129.

Quick analysis: 2018 started with a bit of a bang. FDCPA complaints were at their highest since Aug 2017, FCRA and TCPA were both up from last month and even with all of the drama around CFPB leadership, CFPB complaints had (by far) their highest month ever with 4925 complaints. The next highest months were August 2017 with 4650 and March 2017 with 4648.

As CFPB and BBB data takes a bit longer to settle than litigation data, we delayed reporting full year numbers last month to give the best data we could. Here are your full year reports for 2017:

This includes 4666 (95%) timely responses to complaints, and 259 (5%) untimely responses.

Quick analysis: Well, it’s done. The year 2017 ended on a bit of a whimper, with FDCPA litigation down -5.8% and TCPA (shockingly) down -9.3%. This is TCPA’s first year-over-year decline since TCPA lawsuits became more than a novelty in the late-2000’s. Only FCRA posted an increase, up +9.9% over 2016.

Here are year-over-year litigation numbers for FDCPA, FCRA and TCPA from (essentially) the beginning of time.

CFPB complaints ended the year up a strong +18.5% over 2016, though that may still tick up a bit as more complaints come through the portal. BBB complaints are nominally up over last year, +1.3%, though we do expect that number to rise a bit as well over the next few weeks. Because of the slower schedules for these two categories, full year-over-year reports will come next month.

Back to December…

For the month of December, everything was down except for CFPB complaints, though again BBB will likely add quite a bit of volume over the next few weeks and turn into a positive. FDCPA, FCRA and TCPA were all down from November (-9%, -14.3% and -18.01%, respectively)

Quick analysis: In the month of November, every type of complaint that was down for the month is up for the year, and vice versa. Sort of like the Bizarro version of the monthly stats!

Other than that, all of the complaint types seem to be more or less sticking to the script for the month. BBB complaints dropped by -22.6% over October (though early results tend to be low so it may be adjusted next month), CFPB complaints were surprisingly down -12.1%, FDCPA and TCPA were up (+6% and +17.6, respectively) and FCRA complaints dropped by -4.9%.

No huge year-to-date surprises in November 2017… FDCPA and TCPA are down YTD (-5.7% and -8.6% respectively), FCRA is up (+9.9%), BBB complaints are running close to last year (+1.9%) and CFPB complaints hit it out of the park (+19.7%)

Quick analysis: Yep. TCPA.

It looks like TCPA will end down from the previous year for the first time since, well, ever. Sitting at 3758 (at the end of Oct) with two months to go in 2017, it is really hard to see how TCPA makes up ground to surpass 2015’s record total of 4855 suits. With 1097 suits separating us from last year’s record and 2017’s average of 376 TCPA plaintiffs per month, it just doesn’t seem possible. We’ll see…

Beyond that, FDCPA had a rare “up” month, rising 3.3% over Sept but still down 6.8% from last year. And FCRA continues to be the star of 2017. Even though it was down by a lot (34.1%) from last month’s crazy high of 557, it is still 12.3% up over last year’s record high of 3291 for the first ten months of the year.

We are still getting a handle on the flow of BBB complaints so don’t read much into the wild swings month-to-month yet. October’s 2421 complaints is a solid number, and it is likely to go up a bit when all the data is in. For reference, Jan-Sept averaged 2930 complaints each month.

And finally, CFPB complaints continue their mad dash to a new record high, up 12.2% over last month and 20.5% over this time last year.

Quick analysis:

In another month where just about every type of consumer complaint was down, FCRA broke out with an almost 60% increase over the prior month.

Why? Who knows. But FCRA alone is on a bit of a tear this year, up 13.5% YTD while FDCPA and TCPA(!) are both down over 6% YTD.

FCRA’s increase keeps it in line with the aggressive growth in recent years. However, for those of you who have been watching this data for a while, it should be somewhat surprising to hear TCPA remains down. Without a significant change in plaintiff filing behavior, we are actually on track to see TCPA filings drop from the previous year for the first time since, well, since the start of TCPA litigation.

In CFPB news, while it is still historically high, CFPB complaints had their slowest month of the year with *only* 3239 complaints filed. CFPB complaints are still more than 20% YTD and are certainly going to set a new record when the year is up.

And in BBB news, we spoke too soon last month. Once the numbers shook out, August BBB complaints against debt collectors weren’t only *not* way down from the previous month, but they had actually set a record for the most complaints ever logged in a month (1859) which topped the previous record set the month before (July, with 1798). (oops…). In September, the total was almost certain to lose momentum, and it did, dropping to 1466 complaints.

Here is a month-by-month look at CFPB & BBB complaints so far in 2017.

Putative class actions took an interesting twist last month with 23.7% of FDCPA, 18% of TCPA and an insane 44.1% of FCRA lawsuits filed that way.

About 31% of all plaintiffs who filed suit last month had filed at least once before, an historically low number (it is usually 33-36%).

And finally, Chicago attorney Celetha Chatman takes the crown for the first time as the most active consumer attorney this month by representing of 31 consumers in September. New York attorney Craig B. Sanders retains it for representing the most consumers year-to-date (411).

Quick analysis:

After July’s stunning drop in consumer litigation across the board, August saw an almost equally stunning course correction, bringing all three main statutes (FDCPA, TCPA, FCRA) to within 5% of where they were at the same time last year.

The big three statutes are all up double digits over the previous month (FDCPA +28.1%, TCPA +35.5% and FCRA +16.2%). CFPB complaints continue their 2017 streak up 7.5% over last month. Only our BBB complaint data was down significantly from last month. However, since BBB tracking is new for us it may be premature to accept these numbers as settled, so keep watch as we figure out the BBB trends.

About 34% of all plaintiffs who filed suit last month had filed at least once before.

And finally, New York attorney Craig B Sanders takes back the crown as the most active consumer attorney this month with representation of 51 consumers in August, and for representing the most consumers year-to-date (384).

Quick analysis: A Stunning Fall…

And we ain’t talking about the coming autumn. FDCPA, FCRA and TCPA litigation all tumbled in July, after two of the three fell in June as well. May was the last robust month for consumer litigation.

How much did the numbers fall? All three statutes were down between 20% and 40% over the previous month. In fact, we had to go all the way back to January 2015 to find the last time numbers were this low across the board.

 

After two straight months of slippage (with the exception of a slight increase in FCRA June over May), FDCPA is down more than 5% YTD, and TCPA down 2.6% YTD. Only FCRA posted a slight gain, up 6/10 of a point from 6.2% to 6.8% YTD.

NEW: We are excited to add BBB tracking to our monthly stats. BBB complaints against debt collectors and creditors rose quite a bit over the last month (+11.4%), but are only slightly up YTD from last year (+.9%).

CFPB complaints are continuing their 2017 rally, up 12.4% over last month and a whopping 26.9% over this time last year.

Quick analysis: WebRecon Stats for June 2017: Mostly Downward Movement, But Not Really…

Quick analysis: After a very robust May, June tells a different story with CFPB complaints down 26.1%, FDCPA complaints down 7.8%, TCPA complaints down 11.3% and FCRA complaints up 2.4%.

But… CFPB complaints are still up 21.7% year-to-date (YTD), TCPA complaints are still up 3.8% YTD and FCRA complaints are up 6.2% YTD. Only FDCPA suits are down at 3% YTD.

“Moral of the story… there is very little comprehensible pattern to be discerned, beyond the fact that the overarching pattern seems to be pretty steady in spite of the monthly ups and downs” said WebRecon CEO Jack Gordon.

Here are some raw numbers for the first six months of 2017: 7865 unique consumer plaintiffs filed 5230 FDCPA, 2494 TCPA and 2115 FCRA lawsuit actions against debt collectors and creditors.

Putative class actions were relatively stable last month with 19.1% of FDCPA, 12.0% of TCPA and 11.9% of FCRA lawsuits filed that way.

About 32% of all plaintiffs who filed suit last month had filed at least once before.

And finally, Florida attorney Christopher W Boss took the crown for representing the most consumer plaintiffs (74) in June (all in ONE lawsuit!), and New York attorney Craig B Sanders keeps the crown for representing the most consumers year-to-date (314).
