Quick analysis: Lawsuits & Complaints Mostly Down
In April, CFPB complaints (-2.4%) and consumer lawsuits (TCPA -2.5%, FDCPA -24.2%) were mostly down, with the exception being FCRA litigation (+4.0%) which was up. This closely follows the YTD trend so far, with TCPA (-35.2%) and FDCPA (12.4%) down and FCRA (+6.7%) up, while CFPB complaints (-.7%) are down a sliver.
In other news, putative class actions represented 9.2% of FDCPA, 51.3% of TCPA and 1.7% of FCRA lawsuits filed last month. About 43% of all plaintiffs who filed suit last month had filed at least once before. And finally, Virginia attorneys Leonard Anthony Bennett, Craig Carley Marchiando, Drew David Sarrett shared the top spot for representing the most consumers in April (an explosive 107) while Florida attorney Jibrael S. Hindi has represented the most consumers for the year so far (199).

Quick analysis: Lawsuits Up Across The Board
CFPB complaints (+8.3%) and consumer litigation (FDCPA +10.6%, TCPA +10.1%, FCRA +17.3%) all spiked by double-digit percentages across all three major consumer statutes in March. However, only FCRA (+3.8%) is up YTD. CFPB complaints (-2.8%), FDCPA (-3.6%) and TCPA lawsuits (-39.8%) are all down compared to this time last year.
In other news, putative class actions represented 15.8% of FDCPA, 49.2% of TCPA and 4.8% of FCRA lawsuits filed last month. Those percentages are all up from the previous month as well. About 43% of all plaintiffs who filed suit last month had filed at least once before. And finally, Georgia attorney Matthew Thomas Berry and Florida attorney Thomas John Patti tied for the top spot for representing the most consumers in February (41) while Patti’s colleague Jibrael S. Hindi has represented the most consumers for the year so far (182).

Quick analysis: After a strong start to 2022, litigation tumbles in Feb
FDCPA (-12.9%), TCPA (-16.8%) and FCRA (-19.8%) were all down by double-digit percentages in February. CFPB complaints, however, were up +8.4% over January.
While it is WAY too early to identify trends for 2022, we will note that FDCPA is actually up YTD by +.3%, while TCPA is down YTD by -39.8% over the first two months of 2021. Both kind of interesting numbers, particularly the TCPA one.
In other news, putative class actions represented 10% of FDCPA, 44% of TCPA and 2.6% of FCRA lawsuits filed last month. About 45%(!) of all plaintiffs who filed suit last month had filed at least once before. And finally, Florida attorney Jibrael S Hindi took the top spot for representing the most consumers in February (54) and his colleague at the same firm Thomas John Patti has represented the most consumers for the year so far (124)

Quick analysis: 2022 Starts With a Bang
CFPB Complaints (+1.9%) inched up over December, but FDCPA (+13.1%), FCRA (+14.2%) and TCPA (+35.1%) lawsuits all exploded out of the gate with double-digit percent increases over their previous month numbers.
In other news, putative class actions represented 9.1% of FDCPA, 39.7% of TCPA and 4.0% of FCRA lawsuits filed last month. About 43%(!) of all plaintiffs who filed suit last month had filed at least once before. And finally, Florida attorney Thomas John Patti took the top spot for representing the most consumers in January and the year so far with 79 consumers represented.

Quick analysis: In December, FCRA led the way with a 12.8% increase over November, while TCPA (-6.7%) and FDCPA (-3%) were both down. The pattern holds for full year numbers as well, with FCRA (+3.5%) up and TCPA (-48.3%) & FDCPA (-4.4%) both down for the full year of 2021.
CFPB complaints against creditors and debt collectors slipped in December by -13.6%, but were up for the full year a pretty significant +30.4%.
In other news, putative class actions represented 18.2% of FDCPA, 38.1% of TCPA and 2.6% of FCRA lawsuits filed last month. About 39%(!) of all plaintiffs who filed suit last month had filed at least once before. And finally, New York attorney Craig B Sanders* took the top spot for representing the most consumers in December (20) while Georgia attorney Matthew Thomas Berry was the most active consumer attorney of the year with 298 consumers represented in all of 2021.

Quick analysis: Happy Holidays! Lawsuits and Complaints are Down!
Just in time for the holiday break, we are happy to report a dramatic lull in consumer litigation for November. CFPB complaints were down a bit (-2.2%), though are still up a significant +32.5% YTD. However, FDCPA (-22.7%), TCPA (-10.3%) and FCRA (-13.6%) litigation are all down double digits over the previous month which is sure to help spread some holiday cheer.
In other news, putative class actions represented 15.5% of FDCPA, 49% of TCPA and 3.9% of FCRA lawsuits filed last month. About 43%(!) of all plaintiffs who filed suit last month had filed at least once before. And finally, Florida attorney Thomas John Patti again took the top spot for representing the most consumers in November (46) while Georgia attorney Matthew Thomas Berry is still the most active consumer attorney of the year with 282 consumers represented so far in 2021.

This week we are thankful for a report that shows CFPB complaints (-3.7%) down from the previous month for a third month in a row, though we are less thankful to see TCPA (+3.6%), FDCPA (+14.7%) and FCRA (+20.2%) lawsuits all up over the previous month.

Just in time for Halloween, we are pleased to report that September’s litigation numbers were anything but frightful across the board.
FDCPA was down -12% from Aug and -6.7% YTD. TCPA was down -6.7% from Aug and -49.4% YTD (but view that with skepticism, as last year’s numbers were badly skewed by some abnormal filings). And FCRA was down 17.1% from Aug but still ekes out a +4.7% increase YTD.
Even CFPB complaints were down a few points, -3.3% lower than Aug but still going strong for the year at +36.1% YTD.
In other news, putative class actions represented 12.5% of FDCPA, 46.4% of TCPA and 3.8% of FCRA lawsuits filed last month. About 44%(!) of all plaintiffs who filed suit last month had filed at least once before. And finally, Georgia attorney Matthew Thomas Berry took the top spot for representing the most consumers in August (29) and being most active consumer attorney of the year with 236 consumers represented so far in 2021. Honorable mention to attorney Michael T George who filed one FDCPA lawsuit representing 36 plaintiffs.

Quick analysis: Summer Divergences
August was marked by a few interesting divergences among the data. First, FDCPA lawsuits were up (+7.5%) over the previous month while down (-6.4%) YTD from 2020. TCPA lawsuits were down (-7.7%) from the previous month and YTD (don’t use our YTD comparison, it is tainted by a crazy 2020 filing with a zillion plaintiffs in it). And FCRA was up both over the previous month and YTD (+8.5%, +7.3%, respectively).
Also, CFPB complaints, which have been on a tear this year, were down quite a bit from July (-18.2%) while still being up (a whopping 37.2%) from 2020.
In other news, putative class actions represented 21.1% of FDCPA, 47.5% of TCPA and 3.2% of FCRA lawsuits filed last month. About 40% of all plaintiffs who filed suit last month had filed at least once before. And finally, Georgia attorney Matthew Thomas Berry took the top spot for representing the most consumers in August (42) and being most active consumer attorney of the year with 207 consumers represented so far in 2021.
